Hours of Service Regulations Violation Penalties

If law enforcement finds a driver in violation of a HOS rule, they stop that truck in its tracks. If this happens, the truck sits on the side of the road until the driver has enough off-duty time to be in compliance and can again drive the truck.

Although there are many specific techniques involved in professional and defensive driving, I would like to explain three key concepts that I believe are cornerstones to this skillset: 1) preventability versus fault, 2) following distance, and 3) detachment from other drivers.

May not drive beyond the 14th consecutive hour after coming on duty, following 10 consecutive hours off duty. Off-duty time does not extend the 14-hour period.

First step – prior to appeal

The NYS DMV gives you 2 opportunities to challenge a denial of restoration after a DWI or alcohol related incident caused a revocation. You can make an immediate appeal to the NYS DMV appeal's bureau, or you can re-submit your application with new, different, or updated evidence.

Does my 30-minute break still count against my 14 hours? Yes. FMCSA did loosen the parameters around taking the required 30-minute break, but it still counts against the 14-hour on-duty clock.

Drivers can pause the 14-hour clock today

The break must be spent off duty or in a sleeper berth (or using a combination of the two). The time before and after the break cannot include any driving after the 11th hour of driving or after the 14th hour of time.

According to the new HOS rules, the 8/2 split states that a driver may drive for up to six hours, and then take a two-hour off-duty break before driving another five hours.

The 7/3 sleeper berth split: In a 7/3 split, you start with 7 consecutive hours off in sleeper berth status and then complete your required break by taking your next 3 hours later in the day. Similar to the 2/8 split, you can take a 3/7 sleeper berth as well.

What is the split break rule? ›

The mechanics of split sleeper berth. Section 395.1(g) of the federal hours of service rules says that drivers whose trucks are equipped with a sleeper berth can obtain the “equivalent of a 10 hour off duty break” by taking 2 separate non-consecutive breaks that together equal at least 10 hours.

The Department of Motor Vehicles has reported that: 1,040 people have permanently lost their licenses. 902 people have received five-year extensions on their license revocations. 21 people have received two-year extensions on their license revocations.

The suspension is typically for 60 days. Accumulation of points. In NY, after accumulating 11 points or three speeding tickets within 18 months your driving privileges will be suspended. The 18-month period will begin from the date of the first violation, not the date of being found (or pleading) guilty.

Under the sleeper berth provisions, a driver takes 7 hours in the sleeper berth & later takes an off-duty period of 3 hours before arriving at home.

DOT hours. A summary of how much time a driver has left before violating specified Hours of Service rules. If the driver is actively driving, negative values show that the driver violated the rule by the number of hours and minutes shown.

Sometimes truck drivers need to move their truck when they're not “on-duty”. By recording this off-duty driving time as “personal conveyance”, the movement doesn't count against the driver's available hours of service.

Can You Go Off Duty While Being Loaded? While a driver is loading and unloading, they must log this time as on duty according to FMCSA rules. It doesn't matter whether a driver is on the clock physically, or whether they are assisting or even if they are just watching the loading happen. They must log it on duty.

Guidance: No. The 11 hours of driving time between the first and second sleeper berth periods must be considered in determining the amount of time that the driver may drive after the second sleeper berth period. Sleeper berths are intended to be used between periods of on-duty time.

Stopping suddenly and without warning is one of the biggest mistakes drivers make, and it leads to one of the highest incidents of accidents on roads and highways. Drivers should always be conscious of the cars behind them, and should stop slowly and with care — giving everyone nearby a chance to react and adjust.

License, Insurance, and Registration

It may seem obvious, but you should always have your license, registration, and insurance in the car whenever you are driving it. Especially when the new insurance card comes in the mail, remembering to actually stick it in the glove box could take months.

“Aiming high in steering” means don't make your steering adjustments based on what is directly in front of you. Instead, look way down the road and as far into the turn as possible.

A driver may use a 7/3-split (sleeper berth for 7 hours, 3 hours off-duty) or an 8/2 split (sleeper berth for 8 hours, off-duty for 2 hours). Commodity drivers are still prohibited from driving more than 11 hours inside the 14 hour window.

At this point, the driver takes an 8-hour break in the sleeper berth which effectively pauses the 14-hour clock. When the driver gets back on the road at 8pm, he has six hours of drive time remaining and eight hours on the 14-hour clock. He then drives for six additional hours before taking two hours of off-duty time.

How much time do you get back on a 8 2 split? ›

At this point, the driver takes an 8-hour break in the sleeper berth. This time, taken in the sleeper, effectively stops the 14-hour clock. At 9 p.m., the driver gets back into the driver's seat and still has 6 hours of available drive time and 8 hours on the 14-hour clock.

One shift must be 2-8 hours (2/8 hour period) and can be spent in the sleeper berth, off-duty, personal conveyance or a combination of the three. The second shift must be 8-10 hours (8/10 hour period) long and must be taken in the sleeper berth. The two breaks can be taken in any order.

The maximum duty period is 12 hours. May drive the entire 12 hours.

A driver may also use the sleeper berth in a different way to get the “equivalent of at least 10 consecutive hours off duty.” To do this, a driver must spend at least 8 consecutive hours (but less than 10 consecutive hours) in the sleeper berth. This rest period will not count as part of the 14 hours.

A 45-minute break can be split in to two parts as long as they're both taken over the same driving period. This is known as a split break.

For those not familiar, the split sleeper berth rule allows commercial drivers to split their mandatory 10-hour rest breaks into two non-consecutive segments and still reset their substantive time limits. The shorter of the two segments must be at least two hours long.

Jail term and fines

A third DWI conviction within 10 years in New York State carries one to seven years of prison term and/or a fine of $2,000-$10,000. However, if you get three DWI convictions within five years, you will receive a mandatory minimum sentence of 10 days behind bars.

LICENSING AGENCY HOW WILL A CRIMINAL RECORD AFFECT GETTING A LICENSE? The application asks if you have any criminal convictions (felonies and misdemeanors) and open criminal cases. There is no automatic disqualification for any conviction.

Penalties for a Second DWI Offense in New York

Second offenses of DWI are much more serious. While first offenses are considered misdemeanors, a second offense of DWI in the span of ten years is a Class E felony. These come with the following penalties if you are convicted: Fines of between $1,000 and $5,000.

Revoked driver license or driving privilege

In most cases, before you can get a new license you must first request approval from DMV when the revocation period is over. You may be required to take the written and driving tests again and pay a license reapplication fee.

What happens if you get caught driving with a revoked license in NY? ›

If you have a definite suspension, your suspension order will tell you how long the suspension period will last. You cannot drive until the suspension period ends, you pay a suspension termination fee of $50 and have a valid driver license.

Convictions for operating a motor vehicle under the influence of alcohol or drugs (DWI) are displayed for 15 years from the date of conviction. Convictions for DWAI are displayed for 10 years from the date of conviction. Some serious violations, such as vehicular homicide, may be displayed permanently.

For example, if you are convicted of misdemeanor DWI, your license will be revoked for 6 months. In the case of felony DWI convictions, your license will be revoked for a minimum of 1 year.

The 14-hour logbook rule defines the truck driver's full shift, which includes both driving time and shorter breaks in between. Meanwhile, the 11-hour rule states that a driver may not drive for more than eleven hours total in any fourteen-hour shift.

In 1996, the agency gave advanced notice of its plan to make substantive changes to the rules. 2003: FMCSA issued a final rule that was significantly different from its initial proposal. It extended driving time to 11 hours but cut the driving window to 14 hours, not extendable by breaks.

Does my employer have to give me a schedule or minimum hours of work? If you work a shift that's less than 3 hours, you might still have the right to be paid for 3 hours. The “3-hour rule” says that your employer has to pay you for 3 hours if they ask you to work less than 3 hours.

At the end of the 10 consecutive hours of combined sleeper and/or off-duty time, a driver's 11-hour driving and 14- hour duty-period limits would completely restart. A driver may also use the sleeper berth to extend the 14-hour limit.

Within the 14-hour workday, property-carrying drivers are only permitted to drive their truck for a maximum of 11 hours after 10 consecutive hours of OFF-Duty time. This means they cannot drive for more than 11 hours in a day without a long break of OFF-Duty time.

Is yard move on duty or off duty? ›

A yard move is considered on-duty (not driving). To log on-duty (not driving) it is prudent to only use the “yard move” option when a driver is not on a “highway”, in other words, in an area open to public travel.
